Terms of Use

These Terms of Use ("Terms") govern your use of the YourFlex mobile application (the "App") and related services (collectively, the "Services"). The Services are provided by Andrei Kavaliou (sole proprietor), Poland, with an address at Warsaw, Poland ("YourFlex," "we," "us"). Support: yourflex.co@gmail.com
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
These Terms incorporate by reference our Privacy Policy and Health & Safety Guidelines (together, the "Policies"). If there is a conflict between these Terms and the Policies on privacy or safety topics, the Policies control for those topics.
Changes to Terms. We may revise these Terms from time to time. We will provide notice of material changes (for example, by in‑app notification or email) and indicate the "Last Updated" date at the top. Unless otherwise required by law, changes will take effect immediately upon posting. Your continued use of the Services after changes take effect constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the Services and cancel any subscription before the next billing cycle.
1) Eligibility
You must be at least 13 years old (or the minimum age required by law in your country) to use the Services. The Services are not directed to children under 13. If you are between 13 and the age of legal majority where you live, you may use the Services only under the supervision of and with permission from a parent or legal guardian, who agrees to be bound by these Terms on your behalf. To purchase a subscription or start a free trial, you must be at least 18 years old or have the consent of a parent or legal guardian.
2) License and acceptable use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms and Apple's usage rules.
You agree not to:
- copy, modify, reverse engineer, decompile, or attempt to extract source code from the App;
- redistribute, resell, publicly display, or commercially exploit App content (including videos, workouts, and audio);
- misuse the Services, interfere with security, or attempt to bypass limitations or access controls;
- scrape the Services or use any automated means (bots, spiders, crawlers) to access or extract content;
- share your subscription access or any paid content with third parties;
- upload, post, or generate any content that is defamatory, harassing, violent, threatening, pornographic, racist, or otherwise unlawful or inappropriate;
- use the Services in a way that is unlawful, harmful, or infringes third-party rights.
You agree all content, videos, workouts and materials in the App are owned by YourFlex or its licensors. We do not grant any intellectual‑property rights except as expressly provided in these Terms.
Your use of the Services may also be subject to applicable third-party terms (including Apple's terms), and you agree to comply with them.
IP complaints. If you believe content in the Services infringes your intellectual property rights, contact us at yourflex.co@gmail.com with (1) the work claimed to be infringed, (2) where it appears in the App, and (3) your contact details and a good-faith statement. We may remove content or restrict access where appropriate.
3) Subscriptions and billing
Some features require a paid subscription. Subscriptions (including any free trials) are processed by Apple In-App Purchase and are linked to your Apple ID.
Important subscription terms (summary):
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel subscriptions in your Apple ID account settings.
- Deleting the App does not cancel your subscription.
- If available, a free trial converts to a paid subscription unless canceled before the trial ends.
- Use Restore Purchases to regain access on a new device or after reinstall.
- We will notify you in advance of any price increase or material change to your subscription. Continued subscription after a price change constitutes your agreement to the new price.
- Each Apple ID may redeem only one free trial. Trial length and pricing will be shown before you subscribe. By beginning a free trial or subscription, you request immediate access to digital content. Where applicable law provides a withdrawal right for digital services (e.g., EU/UK), you acknowledge that your right of withdrawal may be lost once performance begins, to the extent permitted by law.
Refund requests are handled by Apple under Apple's policies.
To request a refund (where available), follow Apple's process (for example, via Apple's "Report a Problem" flow) and Apple will determine eligibility.
We do not have access to your Apple payment method and cannot issue refunds for App Store purchases. Refund eligibility and processing are determined by Apple.
4) Health disclaimer
YourFlex provides general fitness and stretching content for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a physician or qualified health provider before starting any exercise program, especially if you are pregnant, nursing, have a medical condition, or have experienced a recent injury. If you experience dizziness, pain, shortness of breath or any other discomfort while using the Services, stop immediately and seek medical attention. Our Services do not provide emergency medical or mental‑health services. In case of emergency, call your local emergency number.
Your use of any workout, stretch, or recommendation is at your own risk. You are responsible for choosing activities appropriate for your condition and abilities. Please follow the Health & Safety Guidelines inside the App.
4A) Health & Safety Guidelines
Overview
YourFlex provides general stretching and flexibility guidance for fitness and wellness. It is not medical advice and is not a substitute for professional medical care. If you are between 13 and the age of legal majority where you live, use the App under the supervision of a parent or legal guardian.
Before you start
- If you have a medical condition, are pregnant or postpartum, are recovering from surgery, or have an injury, consult a qualified healthcare professional before doing stretching or exercise.
- Start gently and progress gradually. Choose ranges of motion that feel controlled and comfortable.
- Warm up first (light movement) before deeper stretches.
During a session
- Stretch to mild tension—not pain. Do not force a position or bounce.
- Stop immediately if you feel pain, numbness, dizziness/vertigo, shortness of breath, or chest discomfort.
- Modify or skip any movement that feels unsafe for your body.
Food, hydration, and environment
- Avoid heavy meals right before stretching. Many people feel best stretching at least 1–2 hours after eating.
- Stay hydrated and make sure you have a safe, clear space and stable footing.
If you selected a condition in onboarding
Use extra caution and seek medical guidance if you selected: arthritis, chronic pain, dizziness/vertigo, fibromyalgia, heart condition, high blood pressure, osteoporosis, injury, sciatica, herniated disc, surgery, or pregnancy.
AI-generated sessions
- Some sessions may be generated using third-party AI based on the information and prompts you provide.
- AI-generated content may be inaccurate or incomplete and may not account for all injuries, conditions, or limitations.
- Use your judgment, follow the guidance above, and stop if anything feels wrong.
If an AI-generated session suggests something that causes pain or seems unsafe for your condition, stop and consult a qualified healthcare professional before continuing.
Emergencies
YourFlex cannot monitor your condition or respond to emergencies. If you think you may be having a medical emergency, stop immediately and seek urgent medical care.

5) AI features
The Services include AI-powered features such as an AI chat and workout/session generator ("AI Features").
Informational nature
You agree and acknowledge that:
- AI-generated sessions and responses are provided for general fitness information and are not medical advice.
- AI outputs may be inaccurate, incomplete, or not appropriate for your circumstances.
- You are responsible for evaluating any AI suggestions before following them and for stopping if something feels unsafe.
Use at your own discretion. AI-generated sessions are general recommendations based on the information you provide and may not be appropriate for your individual circumstances. You are solely responsible for deciding whether to follow any AI-generated session and for exercising safely.
Do not provide personal health records, medical history, payment information, or other sensitive personal data to the AI Features. AI content is generated by a third‑party provider and may contain inaccuracies, omissions, or suggestions unsuitable for your circumstances. We filter and moderate AI inputs and outputs to prevent unsafe, illegal, or abusive content. You agree not to use AI Features to create or distribute unlawful, harassing, hateful, or discriminatory content. We may suspend or terminate your access if you misuse the AI Features.
Third-party processing
AI Features are powered by a third-party language model provider (OpenAI). To generate responses, the App will transmit your prompts and limited context needed to respond to that provider as described in the Privacy Policy.
Limits and anti-abuse
AI Features are subject to limits (for example, 10 requests per day). Limits may change over time to protect service quality, prevent abuse/fraud, and manage costs.
You agree not to:
- attempt to bypass, manipulate, or evade AI usage limits;
- use automation to generate requests;
- use AI Features to generate unlawful, harmful, harassing, or otherwise prohibited content.
We may suspend or restrict AI access (or the Services) if we believe you are abusing the system or violating these Terms.
5A) User inputs and feedback
If you submit content to the Services (including AI prompts, messages, or feedback), you grant YourFlex a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and display that content only to operate, improve, and secure the Services, as described in the Privacy Policy. You represent you have the rights to submit it and that it does not violate law or third-party rights.
6) Data we collect
YourFlex collects certain information to provide and improve the Services, including onboarding inputs, usage analytics, subscription status, and AI prompts. Details about what we collect, why we collect it, and how it's shared are in the Privacy Policy.
7) HealthKit
If you choose to connect Apple Health, the App may write your workout duration/history to Apple Health. We do not read or collect any HealthKit data from your device. We do not use HealthKit data for marketing, advertising, or data‑mining purposes, and we do not share HealthKit data with third parties. You control all HealthKit permissions via iOS/Apple Health settings, and you may revoke permission at any time.
8) Third parties
We use analytics and advertising measurement partners that may access device identifiers (including the advertising identifier (IDFA) only if you allow tracking via App Tracking Transparency) to measure ad performance and attribute installs/subscriptions.
We will ask for your permission before tracking across apps or websites (App Tracking Transparency). You can change your choice at any time in your device settings. For more information, see the Privacy Policy.
The Services may use third-party services/providers (for example: analytics, paywalls, attribution/ads measurement, AI processing, and Apple services). These providers and the types of processing are described in the Privacy Policy.
9) Retention
We retain information as described in the Privacy Policy. Some data is stored on your device; some may be processed and retained by our service providers under their retention practices.
10) Opt-out and your choices
Your choices and controls (including notifications, Apple Health permissions, and App Tracking Transparency settings) are described in the Privacy Policy.
Push notifications. If you enable notifications, we may send you optional workout/reminder notifications. We do not require notifications for the App to function. You can turn notifications off at any time in iOS Settings. We do not send promotional push notifications unless you have expressly opted in (if such an option is offered). If we materially modify subscription terms or pricing, we will notify you in advance and provide the opportunity to cancel before the changes take effect.
You can stop using the Services at any time. Cancel subscriptions via Apple ID settings.
Force Majeure. We are not responsible for delays or failures caused by events beyond our reasonable control (for example, outages, network failures, natural disasters, governmental actions, or third-party service interruptions).
11) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, secure, or error-free.
12) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOURFLEX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOURFLEX'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) TO YOURFLEX FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
(Some jurisdictions do not allow certain limitations. In that case, these limitations apply to the fullest extent permitted by law.)
Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted by law, including (where applicable) liability for death or personal injury caused by negligence, fraud, or willful misconduct.
12A) Indemnity
You agree to indemnify and hold harmless YourFlex from claims, damages, and expenses arising out of your misuse of the Services or your violation of these Terms.
13) Termination
We may suspend or terminate access to the Services if you violate these Terms or if we discontinue the Services. We may also modify, suspend, or discontinue any part of the Services (including AI Features) at any time. You may stop using the Services at any time.
13A) Changes to the Services
We reserve the right to modify, update, suspend or discontinue the Services or any feature (including AI Features) without liability. Where required by law, we will provide reasonable notice. If we discontinue paid features, you will receive a pro‑rated refund of pre‑paid fees.
14) Apple App Store terms (required acknowledgements)
If you downloaded the App from the Apple App Store:
- These Terms are an agreement between you and YourFlex, not Apple. Apple is not responsible for the App, its content, or support.
- To the extent permitted by law, Apple has no warranty obligation with respect to the App. Any claims relating to the App are between you and YourFlex, not Apple.
- You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15) Governing law
These Terms are governed by the laws of Poland (if you reside in Poland) or, if you reside elsewhere, the laws of your country of residence, unless mandatory consumer‑protection laws require otherwise. Nothing in these Terms affects your non‑waivable rights under consumer law.
15A) Dispute Resolution; Arbitration (U.S. residents only)
Informal resolution first. Before filing a claim, you agree to contact us at yourflex.co@gmail.com and attempt to resolve the dispute informally.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing yourflex.co@gmail.com with your name and statement of your wish to opt out. If you opt out, neither you nor YourFlex will be bound by the arbitration clause.
Arbitration. If you are a resident of the United States, and we cannot resolve the dispute informally, you and YourFlex agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, not in court.
No class actions. You and YourFlex agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Exceptions. Either party may bring claims in small claims court, and either party may seek injunctive relief in court for unauthorized use or infringement of intellectual property.
EEA/UK carve-out. If you reside in the EEA, the UK, or Switzerland, this arbitration section does not apply to you, and you may bring claims in your local courts as permitted by applicable consumer laws.
15B) General legal terms
Entire agreement. These Terms and the Policies form the entire agreement between you and YourFlex regarding the Services and supersede any prior agreements on the same subject.
Severability. If any provision is found unenforceable, the remaining provisions remain in effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.
Headings. Section headings are for convenience only.
Electronic communications. You consent to receive communications from us electronically (for example, within the App or by email). Electronic notices satisfy any legal notice requirements, except where prohibited by law.
